Mississippi man appeals conviction in girlfriend's death - Mississippi News Now

JACKSON, Miss. (AP) - A Mississippi man convicted in 2012 in the death of his girlfriend wants a new trial because a judge failed to conduct a hearing into his arguments of mental disability.


The state Court of Appeals has scheduled oral arguments in the case for Feb. 4 in Jackson.


Robert Wayne Silvia was convicted of murder in Walthall County in the 2010 death of his live-in girlfriend who was found shot and stuffed in a freezer at the couple's home in Jaycess. He was sentenced to life in prison.


Authorities say deputies found the body of 52-year-old Darlene Berthelot was found in the freezer on June 10, 2010, after responding to a call from relatives.


County officials say Berthelot had been dead about four or five days before the body was found.
